Refund & Cancellation Policy

Last updated

1. In short

You can stop a project at any time. What you owe depends on how much work has been done and what has already been committed on your behalf, not on how far through a calendar we are. Where work has not been started and nothing has been bought on your behalf, you get your money back.

All amounts are in INR, which is the currency we invoice in. See the Pricing & Payment Terms for how converted prices are displayed. Refunds are returned in INR by the same route the payment arrived.

2. Before work starts

If you cancel before any work has begun, the deposit is refunded in full, less any third-party costs already incurred in your name. In practice that is usually nothing, because we do not buy domains, licences or hosting before a project is confirmed.

The deposit exists to reserve time in the schedule. Where a start date has been held for you, cancelling with less than 14 days notice means that reserved time cannot be offered to anyone else, and we may retain the portion that covers it. We will tell you which portion that is, in writing, when you cancel — not later.

3. After work starts

Once work has begun, you are billed for the work completed up to the point of cancellation, plus any third-party costs already committed. Anything you have paid beyond that is refunded.

Work is handed over as it stands, including source code and the repository, whether or not the project is finished. A partially built system is still your property under the terms of the engagement, and withholding it would not be a reasonable way to resolve a disagreement about money.

4. Milestone-based work

Where a project is billed against milestones, each milestone is treated separately. A milestone that has been delivered and accepted is payable and is not refundable on cancellation. A milestone that has not been started is not payable. A milestone in progress is billed for the proportion completed, assessed against the deliverable rather than against elapsed time.

5. Retainers and care plans

Retainers are invoiced monthly in advance. You can cancel a retainer at any time with effect from the end of the current month: the month already invoiced is not refunded, because the hours in it have already been reserved for you, but no further month is charged. Unused hours inside a month are not carried forward unless we have agreed that in writing.

6. What we cannot refund

Third-party costs are paid to somebody else and cannot be returned by us. That includes domains, hosting, software licences, paid API usage, app store fees and advertising spend. Wherever possible these are set up in your own name and paid by you directly, specifically so that this situation does not arise.

Payment processing and currency conversion charges levied by banks or gateways are outside our control and are not refundable by us. A refund returned to an international account may therefore settle at slightly less than the amount originally paid.

7. If we are at fault

If something we built does not work as specified, you do not need a refund — you need it fixed, and fixing it is our responsibility. Defects raised within 30 days of handover are corrected at no charge, and this is not limited to that window where the defect is something we plainly got wrong: a deadline is a cutoff for reporting, not a way of escaping an obligation.

If we cannot deliver what was agreed and cannot reasonably remedy it, we will refund the amount paid for the undelivered part without requiring you to argue for it.

Nothing on this page is intended to limit any right you have under the law that applies to you. Where a statutory right gives you more than this policy does, that right prevails.

8. How to request a refund

Email contact@shruj.com with the invoice number and the reason. We will respond within a few business days with either the refund, or a written explanation of the amount retained and why. Refunds are processed within 15 business days of agreement, by the original payment method where that is still available.

9. Contact

If you are unhappy with something, tell us early — a cancellation is a much less satisfactory outcome for both of us than a conversation that fixes the actual problem.

Tell us what is wrong before you decide to cancel. Most of what leads to a cancellation is a misunderstanding that is cheaper to fix than to unwind.
